p.003071: I. GENERAL PROVISIONS
p.003071: Article 1
p.003071: (1) This Law establishes conditions for transplantation of human organs, and assurance of quality and safety of human organs (hereinafter: organs)
p.003071: intended for transplantation for treatment purposes.
p.003071: (2) This Law applies to the procedures of donation, acquisition, taking, testing, determining the characteristics of donors and organs, and preserving, transporting and
p.003071: organ transplants intended for treatment.
p.003071: (3) The provisions of this Act shall not apply to the reproductive, embryonic or fetal organs.
p.003071: (4) Terms used in this Law and regulations adopted thereunder that have a gender meaning, whether or not used in
p.003071: masculine or feminine gender, encompassing male and female gender alike.

p.003071: This Act contains provisions which are in accordance with the following acts of the European Union:
p.003071: - Directive 2010/53 / EC of the European Parliament and of the Council of 7 July 2010 on standards of quality and safety of human organs intended for use

p.003071: - Commission Implementing Directive 2012/25 / EU, of 9 October 2012, on the method of reporting the exchange of human organs intended for transplantation

p.003071: (1) The procedures referred to in Article 1, paragraph 2 of this Act may be carried out only in the manner and under the conditions laid down in this Act.
p.003071: (2) Any procedure in connection with the taking and transplantation of organs may be performed only if it is medically justified, or if it is the most favorable

p.003071: The terms in this Law have the following meaning:
p.003071: 1. A donor is a person who donates one or more organs, whether that donation takes place during life or after death,

p.003071: 4. Eurotransplant International Foundation (hereinafter referred to as "Eurotransplant") means an unprofitable European organ exchange organization,
p.003071: dealing with the allocation of organs at national and cross-border level, the majority of which are Member States of the European Union,
p.003071: 5. An organ is a differentiated part of the human body formed by different tissues, which retains its structure, vascularization and ability to develop

p.003071: which diseases affect the recipient, and avoid any action that could affect the quality and safety of the transplant organ.
p.003071: Article 24
p.003071: The assessment of the characteristics of donors and organs must be carried out before each organ transplant in the manner prescribed by the ordinance issued by the Minister.
p.003071: Traceability
p.003071: Article 25
p.003071: (1) The Ministry and the health institutions participating in the procedures referred to in Article 1, paragraph 2 of this Act shall be obliged to keep the documentation and provide
p.003071: the traceability of all organs procured, assigned and transplanted in the Republic of Croatia from donor to recipient and vice versa.
p.003071: (2) The Ministry is obliged to ensure the implementation of a unique donor and recipient identification system to enable identification
p.003071: donor and finding each organ and recipient associated with it.
p.003071: (3) The method of recording and storing the information referred to in paragraphs 1 and 2 of this Article and the method of reporting to other Member States of the European Union shall prescribe
p.003071: minister by ordinance.
p.003071: Transplant organ transport
p.003071: Article 26
p.003071: Transplantation of organs for transplantation shall be carried out under the conditions and in the manner prescribed by the ordinance issued by the Minister.
p.003071: System for monitoring and reporting of serious adverse events and serious adverse reactions
p.003071: Article 27
p.003071: (1) Health care establishments with a permit for performing the activity of transplantation, and all institutions involved in the procedures referred to in Article 1, paragraph 2 of this
p.003071: By law, they are obliged to establish an effective and proven system for monitoring and reporting of serious adverse events and serious adverse reactions, and a system for rapid
p.003071: reporting and carrying out corrective measures and withdrawal from the administration of organs and solutions that can cause a serious adverse event or a serious adverse reaction.
p.003071: (2) Any serious adverse event and serious adverse reaction of a health care institution referred to in paragraph 1 of this Article shall be obligatory in writing without
p.003071: notify the Ministry and Eurotransplant without delay and take all available measures to reduce damage resulting from any delay
p.003071: serious adverse event and serious adverse reaction and notify the Ministry in writing.
p.003071: (3) Ordinance on the manner of reporting serious adverse events and serious adverse reactions, and on the method of keeping records, deadlines and manner
p.003071: reporting to the bodies referred to in paragraph 2 of this Article and the Member State of the European Union shall be made by the Minister.
p.003071: (4) The Ministry shall be obliged to keep a register of serious adverse events and serious adverse reactions referred to in paragraph 2 of this Article.
p.003071: V. SYSTEM FOR OBTAINING, TAKING, TESTING AND REPLACING BODIES
p.003071: Acquisition of organs
p.003071: Article 28
p.003071: (1) All hospital health care institutions are obliged to participate in the procurement and preservation of transplant organs, including preparation, notification and
p.003071: optimal disposal of donors, and assessment of characteristics of donors and organs in the manner prescribed by the ordinance issued by the Minister.
p.003071: (2) At the proposal of the director of the hospital health institution, the Minister shall appoint a hospital transplant coordinator and / or coordination team (in
p.003071: hereinafter referred to as the coordinator).
p.003071: (3) The coordinator shall organize and coordinate the work within the healthcare institution, and cooperate with the exploration teams and the national coordination
p.003071: body for the purpose of pursuing the activities referred to in paragraph 1 of this Article and ensuring maximum availability and safety of the organ for transplantation.
p.003071: (4) In the case of an international exchange of organs, the coordinator is obliged to ensure the transfer of information on the characteristics of the donor and the organ, in accordance with

p.003071: (1) The activities related to organ donation and transplantation are carried out in accordance with the National Transplantation Program issued by the Minister
p.003071: responsible for health (hereinafter referred to as the Minister), on a proposal from the National Organ Transplantation Commission for a term of four years.
p.003071: (2) The National Organ Transplantation Commission (hereinafter: the Commission) shall be appointed by the Minister for a term of four years, consisting of
p.003071: transplant program representatives, national transplant coordinator, hospital transplant coordinator representative, and
p.003071: representative of an approved immunogenetics laboratory.
p.003071: (3) The Commission shall propose professional guidelines, monitor and analyze the success of transplantation programs, monitor the implementation of the National Transplantation Program
p.003071: program, proposes measures for its improvement, participates in the planning and implementation of health-promotion and educational activities at
p.003071: organ donation and transplantation.
p.003071: (4) The implementation of the National Transplantation Program shall require the participation of health institutions and health professionals, as well as the Commission referred to in paragraph
p.003071: 2 of this Article, in the manner prescribed by the Minister by ordinance.
p.003071: III. PROTECTION OF THE DONORS AND RECIPIENTS OF THE AUTHORITIES AND THE SELECTION AND ASSESSMENT OF THE DONORS

p.003071: 6. maintains the National Waiting List and monitors the allocation of organs in accordance with established criteria,
p.003071: 7. keep a register of serious adverse events and serious adverse reactions,
p.003071: 8. coordinates the work of multidisciplinary teams, persons, health care institutions, institutions and organizations involved in the procedures of taking, transplanting,
p.003071: testing, transportation and exchange of organs for transplantation,
p.003071: 9. participate in organizing and securing the transportation of teams and bodies,
p.003071: 10. Coordinate and enhance cooperation with related foreign and international organizations with a view to organ exchange for transplantation,
p.003071: 11. plans, drafts and participates in the implementation of educational and promotional programs, projects, action plans, guidelines, and strategic documents in the

p.003071: VIII. SURVEILLANCE
p.003071: Article 34
p.003071: (1) Supervision of the implementation and enforcement of this Act and regulations adopted pursuant to this Act, as well as supervision of professional work in
p.003071: health institutions performing the activity referred to in Article 1, paragraph 2 of this Law shall be carried out by the competent inspection of the Ministry.
p.003071: (2) Regular inspection supervision shall be carried out at least once every two years.
p.003071: IX. INFRINGEMENTAL PROVISIONS
p.003071: Article 35
p.003071: (1) A legal person shall be fined between HRK 70,000.00 and HRK 100,000.00 for a misdemeanor if:
p.003071: 1. acts contrary to Article 10 of this Law,
p.003071: 2. take the organ from a living donor for the purpose of transplantation without the decision of the expert team and the ethics committee of the transplant center where

p.003071: I. GENERAL PROVISIONS

p.003071: (1) This Law establishes conditions for transplantation of human organs, and assurance of quality and safety of human organs (hereinafter: organs)
p.003071: intended for transplantation for treatment purposes.
p.003071: (2) This Law applies to the procedures of donation, acquisition, taking, testing, determining the characteristics of donors and organs, and preserving, transporting and

p.003071: (4) Terms used in this Law and regulations adopted thereunder that have a gender meaning, whether or not used in

p.003071: (2) The written statement referred to in paragraph 1 of this Article shall be given by an adult legally capable person to the elected doctor of primary health care medicine, or

p.003071: X. TRANSITIONAL AND FINAL PROVISIONS

p.003071: The Minister shall issue the ordinances for the adoption of which are authorized by this Law within six months from the day this Law enters into force.
